R. vs. E.S. – Vancouver Provincial Court

Charges:  Assault (by choking); Mischief.

Issue: Given the rehabilitative steps we were able to guide our client through, whether it was in the public interest to proceed with the criminal prosecution.

Result: Mr. Gauthier was able to provide information including our client’s counselling records to crown counsel and persuaded Crown to enter a stay of proceedings. No criminal record.

R. vs. B.C. – Vancouver Provincial Court

Charge: Mischief Under $5000.

Issue: Whether it was in the public interest to proceed with a criminal prosecution.

Result: Mr. Gauthier provided information about our client to Crown counsel and was able to persuade Crown that there was no public interest in prosecuting this matter. No charge approved. No criminal record.

R. vs. K.D. – Vancouver Provincial Court

Charges: Assault (domestic).

Issue: Given the rehabilitative steps that we were able to guide our client through, whether there was a public interest in continuing with the prosecution.

Result: Mr. Mines was able to persuade Crown counsel to amend the bail condition to allow “permissive contact” with the complainant, and after providing Crown with a report from our client’s psychologist Crown counsel ended the prosecution. Stay of proceedings. No criminal record.

R. vs. J.F. – Vancouver Provincial Court

Charge: Assault (domestic).

Issue: Whether it was in the public interest to proceed with a criminal prosecution.

Result: Mr. Johnson was able to provide information about our client to Crown counsel and persuaded Crown to not approve any charges in this matter. No criminal record.

R. vs. J.C. – Quesnel Provincial Court

Charges: Assault (domestic).

Issue: Whether it was in the public interest to proceed with the prosecution given the rehabilitative steps we guided our client through.

Result: Mr. Gauthier was able to persuade Crown counsel to stay the criminal charge upon our client entering into a Peace Bond. No criminal record.

R. vs. J.P – North Vancouver Provincial Court

Charges: Assault; Breach of Undertaking (domestic).

Issue: Whether there was a substantial likelihood of a conviction and whether it was in the public interest to proceed.

Result: Mr. Johnson was able to persuade Crown counsel to stay all of the criminal charges and to allow our client to enter into a peace bond. No jail. No criminal record.

R. vs. J.H. – Vancouver Provincial Court

Charges: Assault with a Weapon; Assault Causing Bodily Harm (domestic).

Issue: Whether there was a substantial likelihood of a conviction and whether it was in the public interest to proceed.

Result: Mr. Mines was able to convince Crown counsel to enter a stay of proceedings on the eve of the trial date. No criminal record.

R. vs. S.W. – Vancouver Provincial Court

Charge: Assault (domestic).

Issue: Given that the complainant had instigated the altercation, whether it was in the public interest for our client to be convicted of the offence.

Result: We were able to guide our client through a course of rehabilitation and, after hearing Mr. Mines’ submissions, the Court granted our client a conditional discharge and placed him on a non-reporting probation order for six months. No criminal conviction.

R. v. A.M. – Vancouver Provincial Court

Charge: Assault.

Issue: Whether it was in the public interest to proceed with the prosecution.

Result: Mr. Mines was able to guide our client through a course of rehabilitative steps and was then able to persuade Crown counsel to direct a stay of proceedings. no criminal record.

R. vs. T.Y. – Vancouver Provincial Court

Charges: Domestic Assault (x2).

Issue: Given the extensive rehabilitative steps our client took, whether it was in the public interest to proceed with the charges.

Result: Mr. Mines was able to persuade Crown counsel to enter a stay of proceedings on both charges. Our client was able to reconcile with his family. No criminal record.

R. vs. M.L. – Vancouver Provincial Court

Charge: Assault; Uttering Threats (domestic).

Issue: Given the rehabilitative steps our client achieved under our direction, whether there was a public interest in proceeding with the criminal prosecution.

Result: Mr. Johnson was able to persuade Crown counsel to stay the charges.  All restrictive conditions removed. No criminal record.

R. vs. C.S. – Port Coquitlam Provincial Court

Charge: Assault (domestic).

Issue: Whether there was a substantial likelihood of a conviction.

Result: Mr. Mines was able to point to a lack of evidence with respect to the charge resulting in Crown counsel entering a stay of proceedings. No criminal record.
