R. vs. K.A. – Surrey Provincial Court

Charge: Assault Causing Bodily Harm.

Issue: Whether the complainant and the Crown witnesses gave reliable and crdible evidence at trial.

Result: After vigorous cross examination, the trail judge accepted Mr. Gauthier’s submissions that Crown counsel had failed to prove its case. Not guilty verdict. No criminal record.

R. vs. K.C. – Delta Police Investigation

Charges: Assault Causing Bodily Harm.

Issue: Whether it was in the public interest to proceed with criminal charges for this alleged assault that occured in the context of a recreational sporting activity.

Result: Mr. Mines provided information to the police investigator on our clients’s behalf. Ultimately police decided to not recommend any criminal charges. No prosecution; no criminal record.

R. vs. J.H. – Richmond Provincial Court

Charges: Assault causing bodily harm, Uttering threats.

Issue: Whether it was appropriate for the court to grant our client a conditional discharge in this breach of trust, family member assault case.

Result: Mr. Mines was able to steer our client through a course of significant rehabilitation, and over Crown’s contrary position, the Court agreed with Mr. Mines’ submission that it was appropriate to grant our client a conditional discharge.

R. vs. K.Y. – Surrey Provincial Court

Charge: Assault Causing Bodily Harm.

Issue: Whether the 18 month jail sentence Crown had sought was reasonable in all the circumstances.

Result: Mr. Johnson provided information to the Crown and Court and ultimately persuaded the trial judge to sentence our client to a 7 month conditional sentence , followed ny 18 months probation. No jail.

R. vs. J.K. – Vancouver Provincial Court

Charges: Assault Causing Bodily Harm; Choking; Uttering Threats (domestic).

Issue: Whether the complainant’s allegation was credible, given the alibi evidence Mr. Johnson was able to provide to Crown counsel.

Result: Based on Mr. Johnson’s representations, Crown counsel entered a stay of proceedings on all charges. No jail. No criminal record.

R. vs. L.J.A. – New Westminter Provincial Court

Charges: Assault Causing Bodily Harm, Threatening, Mischief to property, Resist Arrest.

Issue: Whether our client would be sentenced to the 4 month jail sentence Crown was seeking.

Result: On the eve of the trial date, Mr. Mines was able to persuade Crown to only proceed on the assault causing bodily harm charge and, after hearing Mr. Mines’ submissions, the court granted our client a suspended sentence. Crown stayed the remaining charges. No jail.

R. vs. J.M. – Vancouver Provincial Court

Charge: Assault Causing Bodily Harm.

Issue: Whether it was in the public interest for our client to receive a conviction on this charge.

Result: Mr. Johnson was able to direct our client through a course of counselling and to persuade the Court to grant our client a conditional discharge. No conviction.

R. vs. B.C. – Vancouver Provincial Court

Charge: Assault Causing Bodily Harm.

Issue: Given the rehabilitative steps our client had taken, whether it was in the public interest to proceed with the criminal charge.

Result: Mr. Johnson was able to persuade Crown counsel to stay the criminal charge. Our client entered into a Peace Bond for a period of 9 months. No criminal record.
